Georgia Car Insurance Coverage and Rates

Car insurance is required by law in Georgia. Everyone on the road needs to carry a minimum amount in order to be in compliance with financial responsibility laws. Those laws ensure that everyone is responsible for injuries or damages caused when they are at fault in an accident.

While it seems straightforward to just buy some coverage that keeps you legal, it’s a bit more involved than that. If you have a loan, you will need additional coverage.

Georgia Minimum Coverage

Georgia law requires everyone to carry liability coverage. This is in place to pay for injuries and damages to others in the event you are found to be at fault for an accident.

The Georgia Department of Insurance outlines the following mandated insurance coverage for all drivers in the state:

• Bodily Injury Liability in the amount of $25,000 per person and $50,000 per incident
• Property Damage Liability in the amount of $25,000

Georgia is a fault state, which means you are responsible for financial damages when you cause an accident.

You can be sued for damages that exceed the limits of your insurance policy.

That means that carrying just the legal minimum can leave you without enough coverage in the event of a serious accident.

Insurance doesn’t just protect you from an accident; you need to be able to present proof when asked by law enforcement and will be charged with a violation if you fail to do so.

Many states now allow drivers to present that proof in electronic format. According to Allstate, Georgia is one of them.

You can show proof of insurance on your phone or another mobile device, assuming your insurance company provides it. However, as we will cover a little later, Georgia law requires that your insurance information is on file with the state database.

As AAA explains, you are also required to present proof of insurance when you register your vehicle. Insurance companies can submit policy information electronically on their insured’s behalf, but you will still need to carry some form of proof.

Forms of Financial Responsibility

Proof of insurance is the most common form of financial responsibility in Georgia. It’s what most drivers choose to do to protect themselves and keep on the right side of the law.

There is another option, however. Georgia is one of a few states that allows drivers to set up a plan of self-insurance without a minimum number of cars. Most states require a fleet of at least 25 vehicles for self-insurance to be permitted, but in Georgia, there is no such limit.

According to the Georgia Department of Revenue, in order to self-insure you have to file and have approved:

“…(a self-insurance plan that) provides coverage, benefits and efficient claims handling procedures equal to those provided by an automobile liability insurance company and complies with all state laws, rules, and regulations.”

This usually means providing proof of the necessary finances to pay for damages that would otherwise be covered by insurance.

How much of your disposable income (what’s left after taxes) can you expect to spend on car insurance in Georgia? Here’s a look at premiums as a percentage of income over three years. After an increase between 2012 and 2013, the percentage stayed steady into 2014.

Georgia has remained above the national average for some time. In 2014, that national average was 2.40 percent.

Still, Georgia drivers are doing better than their neighbors to the south; Floridians spent an average of 3.15 percent of their disposable income on insurance in 2014. That’s not surprising since Florida has some of the highest rates in the nation.

Eastern neighbor South Carolina has similar rates, at 2.81 percent of disposable income. Alabama to the east is a bit cheaper, landing at 2.5 percent.

The Insurance Information Institute states that 12 percent of Georgia drivers are without insurance, and Uninsured Motorist Coverage (UM) can protect you from those drivers.

An underinsured motorist is one that has insurance, but with limits that aren’t sufficient to cover damages. Underinsured motorist coverage is available in two forms in Georgia.

People with good credit pay lower rates than those with poor credit, but again the rates vary a lot by company.

If you have a clean record, Geico is the cheapest, and they remain the cheapest for drivers with one speeding ticket or one accident.

But if you have a DUI, you will want to avoid Geico. State Farm’s rate for a DUI is nearly $1,800 a year cheaper. In fact, State Farm’s rates don’t really jump much in any particular situation.

The NAIC lists a total of 1,011 property and casualty insurance companies that are licensed to do business in the state of Georgia. It’s worth noting that not all licensed insurance companies will offer car insurance.

Of the insurance companies listed, 23 are domestic and 988 are foreign. That doesn’t mean they are from another country.

A domestic insurance company is headquartered in the state, while a foreign company is headquartered in another state.

That’s a lot of insurance companies to choose from. To find the best, you need to shop around.

Georgia State Laws

Nobody wants to wind up on the wrong side of the law, but it seems like there are so many statutes that are constantly changing it’s hard to keep up. And who can read all that legal language, anyway? You need a simple breakdown of the state laws that are pertinent to you as a driver and car owner.

Car Insurance Laws

You’re aware of the necessity for car insurance in Georgia and are familiar with the minimum requirements. However, there are additional aspects to consider, particularly in relation to Georgia car insurance laws.

How State Laws Are Determined

Insurance laws in Georgia are found in the Georgia State Code, Title 33.  Motor vehicle and traffic laws are found in Title 40. Laws are created and passed by the Georgia General Assembly.

According to the NAIC, all rate filings for statutory coverage by insurance companies in Georgia require prior approval. Rate filings for other coverage are on a file and use basis.

Windshield Coverage

According to Carwindshields.info, Georgia has laws on the books that determine how windshield repair and replacement are handled.

Insurance companies can use aftermarket parts, but it needs to be designated and guaranteed on the estimate.

You have the right to insist on OEM parts for replacement, but you may be responsible for the difference in price.

You also have the right to select the repair shop that does the work, but again you may have to pay the difference in price between your shop of choice and the one chosen by the insurer.

High-Risk Insurance

Drivers can be classified as high-risk for a variety of reasons, but the most common is a poor driving record. Multiple tickets and accidents, DUIs, serious violations, and repeated violations of the financial responsibility laws can all land a driver on the high-risk list.

In some cases, a driver may be required to file an SR-22, which is a special financial responsibility form filed by the insurance company. It proves that the driver is in compliance with the insurance laws. The most common reason for an SR-22 is driving without insurance, but several other violations can also result in the requirement.

Any insurance company can file an SR-22 for you, but not all insurers choose to provide this service.

There are companies that provide insurance specifically for high-risk drivers. These are known as non-standard insurers, and their requirements for coverage are less stringent than standard insurance companies.

There are some situations, however, when even the non-standard companies may turn a driver down. In that case, the Georgia Automobile Insurance Plan (GAAIP) steps in.

The GAAIP is a last-resort option to get coverage when other insurance companies have refused to insure a particular driver.

This high-risk pool assigns each driver to an insurance company, and that company is required to provide a policy. While they do have to rate within certain guidelines, GAAIP doesn’t mean a low-cost option. High-risk insurance is expensive no matter where it’s purchased.

The best way to get off of a high-risk policy and back to a more affordable, standard insurance plan is to improve your driving record, credit, and any other issues that may have landed you there in the first place.

Automobile Insurance Fraud in Georgia

Insurance fraud is against the law in Georgia. According to the Insurance Information Institute, property and casualty insurance fraud costs about $30 billion annually. It may seem like something that only hurts big insurance companies, but the cost of fraud adds up to higher premiums for everyone.

The Georgia Department of Insurance operates a Fraud Investigation Division to investigate possible cases of insurance fraud.

The statute of limitations for a car insurance claim in Georgia is two years for personal injury and four years for property damage.

State Specific Laws

While Georgia tends to have laws similar to the rest of the country, a Savannah Now article on law Georgians may not be aware of reports that there is at least one vehicle law that’s unique to the state.

It’s illegal to have any portion of the vehicle’s tags obscured or obstructed. That includes things like vehicle license plate frames, which must leave the entire tag in clear and complete view.

Vehicle Licensing Laws

This section will take a look at the laws the govern driver and vehicle licensing in Georgia.

REAL ID

As of October 1, 2020, REAL ID requirements will go into place at TSA for all domestic flights. The Department of Homeland Security lists Georgia as one of the states that are in compliance with the law.

Without a REAL ID, travelers on domestic flights will not be able to use their driver license as identification on any domestic flight after the deadline. They will still be able to use other forms of acceptable ID, such as a passport, for travel if they choose not to get a REAL ID license.

In Georgia, the new license is called a Secure ID. The Department of Driver Services (DDS) outlines all of the requirements to obtain a Secure ID. You need to bring a few more documents than you would need for a regular driver license.

You will need:

• Proof of Identity, such as an original or certified document such as a birth certificate, US Passport, Certificate of Naturalization, I-551, etc.
• Your Social Security Card. (A W-2, SSA-1099, or paystub is acceptable if it shows your full social security number)
• Two Documents proving Georgia residency, such as a utility bill.
• If your name is currently different than the “identity document” presented, you must provide a legal name change document  (e.g. marriage certificate, divorce decree, etc.)

Penalties For Driving Without Insurance

The Georgia Electronic Insurance Compliance System is a state-run database that keeps track of insurance policies on all vehicles registered in the state. Insurers provide proof of insurance matching the vehicle’s VIN number electronically.

Law enforcement can access this database to confirm insurance is in place; the database information supersedes any ID card you have on hand (or don’t have) as final proof. In fact, in Georgia, paper insurance cards are no longer accepted as proof of insurance. Your insurance must be on file in the electronic system to be valid.

If there is no insurance policy on file for your vehicle, you will be charged with driving without insurance.

Driving without insurance in Georgia is a misdemeanor offense. Penalties for a conviction include fines of up to $1,000 and jail time of up to 12 months.

In addition to the criminal penalties, you will have your license and registration suspended. There is a $25 lapse fee as well as a $60 reinstatement fee.

Drivers convicted of driving without insurance will be required to file an SR-22 after the second and any subsequent offenses.

Teen Driver Laws

Georgia’s Teenage and Adult Driver Responsibility Act (TADRA) is a Graduated Driver Licensing program for teen drivers. This type of program eases teens into the responsibilities of driving with restrictions and requirements at every stage.

The program has three phases that every teen driver needs to go through in order to become a fully licensed driver.

These are the requirements and restrictions for each stage of the program.

Older Driver Renewal Procedures

According to the Insurance Institute for Highway Safety, older drivers don’t have any real restrictions aside from one.

If you are age 64 or older, you will be required to process all of your renewals in person. Online renewal is only available for drivers under 64.

You will need to renew on the regular cycle, every eight years, and pass a vision test at every renewal.

New Residents

If you are new to Georgia and need to transfer your license, the procedure is pretty straightforward.

Visit your local DDS office with your current out of state license. You will need to pass a vision test and surrender your current license in order to be issued a valid Georgia license.

You will also need to bring along, according to the DDS website, proof of residency and proof of your legal status in the United States. If you’re applying for a Secure ID, you will need to bring everything listed in our section on REAL ID above.

License Renewal Procedures

Every Georgia driver needs to renew their license on an eight-year cycle.

Every second year, you can renew online, as long as you are under the age of 64.

At every renewal, you will need to provide proof of adequate vision.

Negligent Operator Treatment System

Georgia uses a points system to track negligent drivers. Violations will result in points being applied to your license, and those points can add up to one suspended license.

Points for violations can range from 1-6 depending on the offense. There are no points assessed for some violations, such as speeding under 15 mph over the posted limit.

The DDS lists points for many common violations.

15 points in a 24-month period will result in suspension of driving privileges.

Drivers can request a points reduction by completing an approved Driver Improvement course. Points can be reduced by up to seven every five years.

Rules of the Road

This next section will deal with the rules of the road you need to know to stay safe and avoid some of the above-mentioned points on your license.

Fault Vs. No-Fault

Georgia is a fault state. That means that the driver found to be at fault is responsible for damages, and that driver’s insurance company will pay out for injuries and property damage.

The law uses comparative fault in situations where both drivers have some responsibility for the accident.

Here’s an example of how comparative fault works. You’re driving along and hear a text message notification on your phone, which you quickly check. As you look down at your phone, a driver runs a red light and pulls out in front of you. Because you looked at your phone and were distracted, you share some responsibility for the accident, although likely a smaller percentage.

The fault is determined in percentages, and the amount you can recover for the accident is reduced by a percentage of the fault you carry. Let’s say you are found 10 percent at fault in the scenario above, and the other driver 90 percent.

If the damage to your car is $2,000, you will be able to recover 90 percent of that amount, or $1,800.

Seat Belt and Car Seat Laws

Seat belt use is required by law in Georgia. All passengers age 18 and over must use a seat belt in the front seat, and passengers age eight through 17 must use seat belts in all seats.

Passengers under the age of eight and under 57 inches in height are subject to Georgia’s car seat laws. They must always be secured in an approved child safety seat.

While Georgia doesn’t have laws on the books regarding keeping children rear-facing, the American Academy of Pediatrics has published guidelines recommending that children remain rear-facing for as long as possible.

Georgia law allows passengers in cargo areas of pickup trucks when they are not on an interstate or are over the age of 18. Passengers under the age of 18 can ride only in covered cargo areas.

Keep Right and Move Over Laws

If you are moving slower than other traffic around you, even if you are going the speed limit, you must move over into the right lane to let faster traffic pass.

This is known as the “Slowpoke Law”.

As AAA notes, Georgia is also one of the many states with a law that requires you to slow down and/or move over (when safe and possible) for stopped emergency vehicles. The law also applies to utility and road maintenance vehicles.

Speed Limits

Georgia’s speed limit is 70 mph on all interstates, both rural and urban.

The speed limit drops to 65 mph on other limited access roads and all other roads.

Always obey posted speed limits, especially in construction areas where lower speed limits are posted.

Ridesharing

Georgia law requires all rideshare companies to provide $1 million in liability coverage for their drivers from the time a ride is accepted until the passenger leaves the vehicle.

When you’re driving for a rideshare company, you will need to cover yourself outside of that time period. Personal insurance policies are not designed for the liability risks of rideshare driving. There is a gap in coverage that occurs when you turn on that rideshare app but haven’t yet accepted a ride.
